Right of residence

The right of residence for European citizens and right of residence for so called Third country citizens differs. The former have the wide liberality of the Treaty establishing the European Community. The latter have clauses for entry, stay and employment regulated in the German Residence Act. For Turkish employees additionally weighs the Treaty of Association EWG/Turkey, which features certain privileges.

 

There are three types of residence titles: visa, residence permit and settlement permit. The exceptional leave to remain is not a residence title, because it only regulates a transit time. That is why it is called “other residence permit”. Residence titles are only given to certain purposes of stay, such as apprenticeship, employment, humanitarian or familial reasons.

 

Legal status and amendment depend on a lot of different criteria. The rule of thumb is: The longer you live in Germany, the greater your right for legal status is. Therefore it is important to inform yourself and take action. Residence titles are generally given upon application.
